{"id":1517,"date":"2020-10-18T22:40:28","date_gmt":"2020-10-18T22:40:28","guid":{"rendered":"https:\/\/lantyer.com.br\/?p=1517"},"modified":"2021-05-06T17:47:50","modified_gmt":"2021-05-06T17:47:50","slug":"pregnant-woman-can-be-fired","status":"publish","type":"post","link":"https:\/\/lantyer.com.br\/en\/pregnant-woman-can-be-fired\/","title":{"rendered":"Can a pregnant woman be fired?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">The legislation guarantees temporary stability for pregnant women <strong>from the confirmation of pregnancy until 5 months after birth, during which time there may be no arbitrary or unjustified dismissal.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Case law understands that the right to employee stability arises with conception, <strong>regardless of the employer&#039;s knowledge of the pregnancy or confirmation that the pregnancy occurred after a possible dismissal.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of arbitrary or unfair dismissal, <strong>the employee will have the right to be reinstated to work, receiving all the amounts that she would be entitled to if she were working<\/strong>. <strong>If reinstatement is not possible, the worker will be entitled to compensation.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reason for the existence of such stability is to prevent pregnancy from becoming a cause of discrimination against the employee, guaranteeing the continuity of the employment relationship, as well as ensuring the support of the unborn child and the family.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/10\/Gravida-2-1024x684.jpg\" alt=\"\" class=\"wp-image-1519\"\/><figcaption>Photo by <a href=\"https:\/\/unsplash.com\/@by_syeoni?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Suhyeon Choi<\/a> on <a href=\"https:\/\/unsplash.com\/s\/photos\/pregnant?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Unsplash<\/a><\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">However,<strong> dismissal may occur when there is just cause<\/strong>, that is, when the employee violates the relationship of trust in the employment relationship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short, just cause is established when:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Indiscipline or insubordination; <\/li><li>Act of dishonesty (e.g., robbery or theft); <\/li><li>Bad behavior or incontinence of conduct; <\/li><li>Criminal conviction;<\/li><li> Negligence; <\/li><li>Habitual drunkenness;<\/li><li> Violation of company secrets;<\/li><li> Abandonment of employment;<\/li><li> Act that is harmful to the honor or good reputation of the service against any person or against the employer\/superior;<\/li><li> Physical offenses;<\/li><li> Constant practice of gambling;<\/li><li> and finally, loss of license.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, TST Summary 244 established that the stability of pregnant women did not extend to cases where the term of a fixed-term employment contract ended, since the passage of the established time would not constitute arbitrary dismissal or dismissal without just cause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this understanding was modified by the TST, and <strong>Today, stability also applies to cases where there is a fixed-term contract, protecting the employee in all types of employment contracts.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>The legislation guarantees temporary stability for pregnant women from the confirmation of pregnancy until 5 months after birth, and during this period, there may be no arbitrary or unjustified dismissal.<\/p>","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[6],"class_list":["post-1517","post","type-post","status-publish","format-standard","hentry","category-direito-do-trabalho","tag-direito-do-trabalho"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.5 (Yoast SEO v27.5) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Gr\u00e1vida pode ser demitida?
