O estupro j\u00e1 pressup\u00f5e a ideia de que tem que haver dolo, ou seja, tem de existir a inten\u00e7\u00e3o de pratic\u00e1-lo.<\/p>\n\n\n\n<p>A modalidade culposa s\u00f3 poder\u00e1 ocorrer quando estiver prevista em lei, o que n\u00e3o \u00e9 o caso do crime de Estupro.<\/p>\n\n\n\n<p>O dolo ocorre quando algu\u00e9m tem a inten\u00e7\u00e3o ou assume o risco de cometer um crime.<\/p>\n\n\n\n<p>Exemplo: Uma pessoa, com inten\u00e7\u00e3o, pega o notebook de algu\u00e9m.<\/p>\n\n\n\n<p>J\u00e1 a culpa ocorre quando n\u00e3o existe a inten\u00e7\u00e3o, mas voc\u00ea acaba cometendo a infra\u00e7\u00e3o penal. Acontece quando existe imprud\u00eancia (aus\u00eancia de cuidado que ocasiona o crime ou contraven\u00e7\u00e3o penal), neglig\u00eancia (sabendo dos riscos, n\u00e3o toma as devidas precau\u00e7\u00f5es) ou imper\u00edcia (falta do dom\u00ednio da t\u00e9cnica ocasiona a infra\u00e7\u00e3o penal).<\/p>\n\n\n\n<p>Exemplo: Uma pessoa, sem inten\u00e7\u00e3o, se confunde achando que era seu e pega o notebook de algu\u00e9m.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/Culposo2-1024x768.jpg\" alt=\"\" class=\"wp-image-1664\" srcset=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/Culposo2-1024x768.jpg 1024w, https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/Culposo2-300x225.jpg 300w, https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/Culposo2-768x576.jpg 768w, https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/Culposo2.jpg 1267w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Neste sentido, o crime de estupro est\u00e1 previsto no art. 213 do C\u00f3digo Penal, no cap\u00edtulo Dos Crimes Contra Liberdade Sexual, e ocorre quando existe constrangimento, mediante viol\u00eancia ou grave amea\u00e7a, para ter conjun\u00e7\u00e3o carnal (introdu\u00e7\u00e3o completa ou incompleta do \u00f3rg\u00e3o sexual) ou a praticar ou permitir que se pratique outro ato libidinoso (ato que tem por finalidade atender a desejo sexual).<\/p>\n\n\n\n<p>N\u00e3o existe a possibilidade de algu\u00e9m cometer um crime na modalidade culposa, usando-se de viol\u00eancia ou grave amea\u00e7a, como \u00e9 o caso do estupro. O indiv\u00edduo que o comete, tem inten\u00e7\u00e3o de o faz\u00ea-lo.<\/p>\n\n\n\n<p>No estupro temos a pena de reclus\u00e3o de 6 (seis) a 10 (dez) anos.<\/p>\n\n\n\n<p>Se houver les\u00e3o corporal grave ou se a v\u00edtima for maior de 14 (quatorze) anos e menor que 18 (dezoito) anos, temos a pena de reclus\u00e3o de 8 (oito) a 12 (doze) anos.<\/p>\n\n\n\n<p>Por fim, se a conduta resultar em morte, temos a pena de reclus\u00e3o de 12 (doze) a 30 (trinta) anos.<\/p>\n\n\n\n<p>Ficou alguma d\u00favida?
