{"id":1750,"date":"2020-11-28T17:57:41","date_gmt":"2020-11-28T17:57:41","guid":{"rendered":"https:\/\/lantyer.com.br\/?p=1750"},"modified":"2021-05-06T17:43:49","modified_gmt":"2021-05-06T17:43:49","slug":"property-regime-in-marriage","status":"publish","type":"post","link":"https:\/\/lantyer.com.br\/en\/property-regime-in-marriage\/","title":{"rendered":"Property Regime in Marriage"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">De forma bem resumida, o Regime de Bens estabelece como ser\u00e1 a configura\u00e7\u00e3o e administra\u00e7\u00e3o das propriedades do casal.<\/h4>\n\n\n\n<p>Em outras palavras, vai definir como fica a divis\u00e3o dos bens constitu\u00eddos antes e durante o matrim\u00f4nio; estabelecendo como ser\u00e1 a partilha dos bens no caso de falecimento ou de separa\u00e7\u00e3o.<\/p>\n\n\n\n<p>Como n\u00f3s acreditamos que conhecimento \u00e9 poder, vamos buscar explicar cada um dos regimes de bens:<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>&#8211; Comunh\u00e3o Parcial de Bens<\/strong><\/h5>\n\n\n\n<p>A Comunh\u00e3o Parcial \u00e9 o regime padr\u00e3o, ou seja, quando n\u00e3o houver qualquer escolha entre as partes de qual regime pretendem ou se por algum motivo o regime adotado for nulo, ser\u00e3o regidos por ela. A maioria dos casamentos no Brasil s\u00e3o efetuados neste regime.<\/p>\n\n\n\n<p>Aqui, os bens contra\u00eddos durante o matrim\u00f4nio ser\u00e3o de propriedade comum ao casal. Desta forma, para vender algum bem comum ao casal, ser\u00e1 necess\u00e1ria a autoriza\u00e7\u00e3o de ambos os c\u00f4njuges.<\/p>\n\n\n\n<p>Contudo, os bens que o c\u00f4njuges j\u00e1 tinham antes do casamento, n\u00e3o far\u00e3o parte dos bens do casal. <\/p>\n\n\n\n<p>N\u00e3o entram nesta comunh\u00e3o, os bens recebidos a t\u00edtulo de heran\u00e7a ou doa\u00e7\u00e3o; bens adquiridos com valores exclusivamente pertencentes a um dos c\u00f4njuges; obriga\u00e7\u00f5es anteriores ao casamento ou proveniente de atos il\u00edcitos; bens de uso pessoal, os livros e instrumentos de profiss\u00e3o, proventos do trabalho pessoal de cada c\u00f4njuges, dentre outros.<\/p>\n\n\n\n<figure class=\"wp-block-gallery columns-1 is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\"><ul class=\"blocks-gallery-grid\"><li class=\"blocks-gallery-item\"><figure><img decoding=\"async\" src=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/casamento-1024x683.jpg\" alt=\"\" data-id=\"1752\" data-full-url=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/casamento-scaled.jpg\" data-link=\"https:\/\/lantyer.com.br\/?attachment_id=1752\" class=\"wp-image-1752\"\/><\/figure><\/li><\/ul><figcaption class=\"blocks-gallery-caption\">Photo by <a href=\"https:\/\/unsplash.com\/@cinematicimagery?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Cinematic Imagery<\/a> on <a href=\"https:\/\/unsplash.com\/s\/photos\/marry?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Unsplash<\/a><\/figcaption><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>&#8211; Comunh\u00e3o Universal de Bens<\/strong><\/h5>\n\n\n\n<p>Na Comunh\u00e3o Universal de Bens, todos os bens contra\u00eddos pelos c\u00f4njuges, antes e durante o casamento, ser\u00e3o de propriedade comum ao casal.<\/p>\n\n\n\n<p>Ser\u00e3o exclu\u00eddos desta comunh\u00e3o os bens doados ou herdados com cl\u00e1usula de incomunicabilidade e os sub-rogados em seu lugar; bens gravados de fideicomisso; dividas anteriores ao casamento, e as doa\u00e7\u00f5es antenupciais feitas por um dos c\u00f4njuges ao outro com a cl\u00e1usula de incomunicabilidade.<\/p>\n\n\n\n<figure class=\"wp-block-gallery columns-1 is-cropped wp-block-gallery-2 is-layout-flex wp-block-gallery-is-layout-flex\"><ul class=\"blocks-gallery-grid\"><li class=\"blocks-gallery-item\"><figure><img decoding=\"async\" src=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/casamento4-1024x683.jpg\" alt=\"\" data-id=\"1753\" data-full-url=\"https:\/\/lantyer.com.br\/wp-content\/uploads\/2020\/11\/casamento4-scaled.jpg\" data-link=\"https:\/\/lantyer.com.br\/?attachment_id=1753\" class=\"wp-image-1753\"\/><\/figure><\/li><\/ul><figcaption class=\"blocks-gallery-caption\">Photo by <a href=\"https:\/\/unsplash.com\/@exegii?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">sergey mikheev<\/a> on <a href=\"https:\/\/unsplash.com\/s\/photos\/marry?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Unsplash<\/a><\/figcaption><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>&#8211; Separa\u00e7\u00e3o total ou Convencional de Bens<\/strong><\/h5>\n\n\n\n<p>J\u00e1 na Separa\u00e7\u00e3o Total de Bens, como o nome j\u00e1 explica, os c\u00f4njuges ficar\u00e3o com seus bens, n\u00e3o havendo comunh\u00e3o, compartilhamento de bens, antes e durante o casamento.<\/p>\n\n\n\n<p>Ser\u00e1 obrigat\u00f3rio o regime de Separa\u00e7\u00e3o total de Bens quando a pessoa for maior de 70 anos ou quando o casamento depender de decis\u00e3o judicial.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>&#8211; Participa\u00e7\u00e3o Final nos Aquestos<\/strong><\/h5>\n\n\n\n<p>Este \u00e9 um dos regimes mais at\u00edpicos e incomuns no Brasil. Durante o casamento haver\u00e1 separa\u00e7\u00e3o total de bens, com cada c\u00f4njuge administrando seus bens particulares.
